2016年，市民翟女士全款购置香城壹号二层商铺，足额支付购房款并依法缴纳契税、维修基金等全部税费，完整履行购房人全部义务。
四 | 同期，根据开发商统一安排，翟女士与香河云天商业管理有限公司签订租赁协议，合同约定8％的年度租金收益及保底回购条款。
五 | 开发商以此高收益、保本兜底模式大规模售卖商铺，吸引数千名投资者入局。 依据《商品房销售管理办法》第十一条明确规定，房地产企业严禁以售后包租、变相售后包租方式销售未竣工商品房。
六 | 该项目销售运营模式存在先天合规瑕疵，多年违规运营吸纳数亿元社会资金，为后续运营失控、各类遗留问题爆发埋下重大隐患，也违背了商品房销售监管规范，损害了普通购房者的合法权益。 2019年4月，项目风险彻底爆发，负责托管运营的云天商管公司因涉嫌非法吸收公众存款罪被警方立案侦查，公司负责人失联、运营全面停滞，所有业主租金全部停发。自此，翟女士所购商铺陷入全款购置、从未使用、无任何收益的状态，财产权益持续受损，问题搁置至今已达十年。
2026年6月30日，经国家、省、市信访局逐级交办，属地部门再次出具受理文书，限定8月29日前答复，依旧未推动实质问题解决。
七 | 云天公司停摆后，香河大商帮商业管理有限公司在无业主授权、无合法协议的情况下，仅凭与云天公司的私下转租协议，强行接管商场整体运营。该公司擅自将原有8％的年租金收益率下调至2.5%，强制业主重新签约，对拒不妥协的业主，长期占用商铺经营获利，截留全部运营收益，严重侵害购房者合法物权。
八 | 公开工商信息显示，涉事开发商长期存在经营风险，管理层频繁变动，其香海分公司原负责人2019年失联跑路，导致项目产权办理、税费结算、票据对接等后续工作全面停滞，各类问题持续堆积，形成长期悬而未决的楼盘遗留难题。 多年来，该事项历经多轮官方受理督办，却始终未能落地办结。
九 | 2021年8月，当地社区事务中心出具受理文书，承诺限期答复，最终超期无任何反馈。2025年6月，该事项经中央第七巡视组交办督办，专项专班核算确定兑付本金及利息合计1768837.94元，属地部门先后三次明确办结时限，均全部爽约。
十 | 同年9月，相关部门在问题未办结、群众未确认的情况下，拟向上级报送虚假办结信息，被当事人否决，全程证据留存完整。 2026年，经国家、省、市多级信访部门交办，属地两次出具受理文书、限定答复时限，依旧未推动核心问题解决。直至8月13日，当地再度出具最新《受理告知书》，但十年间处置工作始终停留在程序层面，未落实任何实质性解决方案。 随着处置推进，项目多项监管漏洞逐一暴露。该项目千余户商铺普遍存在开发商代收税费、维修基金后未上缴，测绘资料缺失等问题。尽管当地曾开设专项办证通道，但因开发商税费亏欠、资料残缺，大量业主产权证被暂扣，产权长期悬空。
十一 | 同时，开发商及运营方长期滞留合规购房票据，导致业主多年无法完善产权手续，合法房产权益得不到保障。 此外，涉事开发商曾向属地街道缴纳1000余万元问题楼盘专项保证金，存入政府监管账户，专项用于化解项目遗留纠纷、保障购房者权益，完全具备兑付能力。但该笔专项资金的流向、用途及台账多年未公开，始终未能发挥兜底保障作用。 历经十年搁置，当事人提出三项合理诉求：足额兑付购房本金及利息；对历年履职缺位、承诺落空等问题开展核查问责；公开千万保证金台账，核查资金使用情况，彻底化解积案。 社会各界期待，属地职能部门以本次全新受理为契机，严格遵循商品房销售管理相关规定，正视历史遗留问题，补齐履职短板，落实实质性处置举措，闭环解决十年民生积案，严守监管底线，切实守护普通购房者的合法财产权益与政务公信力。（施歌）。
